The alleged victim was operating his vehicle at night when he came to a complete stop on the freeway, parked his car at a 45-degree angle in the fast lane, turned off his lights and apparently went to sleep. Client, who was driving his truck within the speed limit of 65 MPH, came upon him, took evasive action and struck the parked vehicle killing the alleged victim. Since client had one prior DUI, a pending DUI and had been given the Watson advisement, he was charged with second degree Murder. Client’s family retained the Madrid Law Firm. In gearing up for trial, Erica hired an accident reconstruction expert that was going to opine that accident was not her client’s fault, and a toxicologist, and chemist to attack the client’s sobriety issues, methodology and standards used to measure blood alcohol. In addition, Erica conducted two focus groups with the assistance of her dad, Ed Madrid, Esq., John Murray, Esq. and Mark Rosenfeld, Esq. After 2.5 years of litigation and on the eve of trial, the district attorney agreed to dismiss the murder charge in exchange for a plea of driving under the influence. Client accepted. Murder charge dismissed. Client will soon rejoin his wife, son and the rest of his family. Kudos to Erica of the Madrid Law Firm. When faced with any legal challenge, the outcome is determined by who is in your corner.
