FAQ After a Drunk Driving Arrest
Do I need to abide by field sobriety tests?
Yes and no. You do not necessarily have to abide by the field sobriety
tests (walking a straight line, reciting ABC's) but you
do have to abide by breathalyzer tests. Under California implied consent
laws, if you fail or refuse a breathalyzer test, you will lose your license.
Will I lose my license?
Like stated before, California has a complied consent law, which means
that if you refuse a breathalyzer test, you
will lose your license. California assumes that if you are not guilty, you
will not have any problem taking a test - so if you refuse it will be
assumed you are guilty.
Will I need to go to court?
Yes. You will need to attend a hearing for your charges. It can be to your
great advantage to contact an attorney to help guide you throughout these
court proceedings.
I was not read my Miranda Rights, do I have a case still?
Unfortunately, no. Although you are supposed to be read your 5th Amendment
rights, you will not have an excused case. You may be able to get your
charges reduced and it could be a strong defense in your case though and

Do I have the right to an attorney?
Absolutely! It is a part of your Constitutional rights! You have the right
to remain silent, the right to an attorney and the right to a fair trial!

Why did the officer take my license and serve me with a driver's license
suspension notice?
If the breathalyzer test result was above the legal limit or you refused
a breathalyzer test, you will have your license temporarily revoked until
a hearing can be scheduled for you. This hearing will be scheduled within
ten days after your arrest.
Will I need an attorney?
Definitely. You can represent yourself, but this is not recommended. When
